Web privacy: quello che devi sapere sulla “Cookie Law”

Tic tac, tic tac… Il tempo sta per scadere! Mancano pochi giorni alla messa in regola di tutti i siti web.

Dal 2 giugno 2015 entreranno infatti in vigore anche in Italia le nuove normative europee in merito ai “cookie“. Il garante della privacy ha stabilito che ciascun utente che si interfacci con un sito debba essere informato riguardo la possibilità di ricevere file di testo.

Ma cos’è un cookie?

In informatica, file di informazioni che i siti web memorizzano sul computer dell’utente di Internet durante la navigazione, spec. allo scopo di identificare chi ha già visitato il sito in precedenza. (Wikipedia)

Perché si utilizzano i cookie?

Le pagine web non hanno memoria. Se si naviga da una pagina all’altra all’interno di un sito web, non si è riconosciuti come lo stesso utente in ciascuna delle pagine. I cookie consentono di essere riconosciuto dal sito web come utente unico. Permettono inoltre di memorizzare le scelte dell’utente visitatore, per esempio la lingua che preferisce, la valuta che ha impostato e i criteri di ricerca. I cookie consentono anche di essere riconosciuto alla visita successiva.

I cookie sono tutti uguali?

No, esistono vari tipi di cookie e diversi modi di utilizzarli. I cookie si distinguono in base alla funzione svolta, alla loro durata e a chi li ha inseriti in un sito web.

Alcune tipologie di cookie:

Cookie tecnici: garantiscono la normale navigazione e fruizione del sito web;
Cookie analitici: assimilati ai cookie tecnici utilizzati per raccogliere informazioni, in forma aggregata, sul numero degli utenti e su come questi visitano il sito stesso;
Cookie di funzionalità: che permettono all’utente la navigazione in funzione di una serie di criteri selezionati (ad es. lingua, prodotti selezionati per l’acquisto) al fine di migliorare il servizio reso allo stesso;
Cookie commerciali: cookie di proprietà del sito e di terze parti per visualizzare pubblicità personalizzate sui siti web. Questa attività è chiamata “retargeting” ed è basata sulle attività di navigazione, come ad esempio le destinazioni cercate, le strutture che visualizzate e i prezzi che sono stati mostrati. I cookie commerciali potrebbero essere anche utilizzati da terze parti per mostrare i loro prodotti e servizi sul sito che si sta visitando.

Per quanto tempo restano attivi i cookie?

I cookie hanno una durata variabile. La durata massima è di 5 anni a partire dall’ultima visita del sito. In qualsiasi momento è possibile cancellare tutti i cookie dal browser.

 

La cookie law, così è stata denominata, stabilisce che i siti non potranno più installare cookie senza aver informato i visitatori. Dovrà esser perciò presente sul sito, oltre la privacy policy, la cosiddetta “cookie policy” ovvero un’informativa estesa in cui viene dettagliatamente scritto cosa sono i cookie e quale tipologia di cookie quel sito andrà ad installare sui computer dei visitatori.
Per quanto riguarda i cookie commerciali (anche detti di profilazione) non è possibile installarli senza aver precedentemente richiesto il consenso esplicito all’utente mediante banner informativo.
